Terms of Service

You must be at least 16 years old to create an account. By using the Service, you represent that you meet this requirement and that all information you provide during signup is accurate and current.

MisFIT is currently offered to users in Iran, and billing is processed exclusively through ZarinPal in Iranian Rial (IRR). We may expand availability to other regions in the future, which may require updates to these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@joinmisfit.org if you suspect unauthorized use of your account. We are not liable for any loss arising from your failure to safeguard your credentials.

MisFIT is a workout tracking tool. It is not a medical device, medical service, or substitute for professional medical or coaching advice.

MisFIT does not employ physicians, and no content, feature, or output of the Service (including logged data, streaks, or progress charts) constitutes medical advice or a treatment recommendation. You should consult a qualified physician before beginning any exercise program, particularly if you have any pre-existing health condition, injury, or concern. Never disregard professional medical advice or delay seeking it because of anything you see in the Service.

Physical exercise carries inherent risks, including risk of injury. By using MisFIT to log or plan workouts, you voluntarily assume all known and unknown risks associated with your physical activity. You are solely responsible for exercising within your own physical limits and using proper form and equipment. To the fullest extent permitted by law, MisFIT disclaims any liability for injury, disability, or death arising from your use of information logged, stored, or displayed in the Service.

Certain features of MisFIT may require a paid subscription ("Premium"). Pricing and tier details are shown in the Service at checkout.

Payments are processed by ZarinPal. We do not store your full payment card details. Subscriptions do not renew automatically. At the end of each billing period your Premium access will expire unless you manually renew it from your account settings. No partial refunds are issued for unused time.

Refunds are provided only where required by applicable Iranian consumer protection law or at our sole discretion. Deleting the app or your account does not automatically cancel an active subscription. You must cancel it separately.

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms;
• Attempt to gain unauthorized access to other users' accounts or data;
• Reverse-engineer, scrape, or interfere with the Service's normal operation;
• Upload content that is defamatory, harassing, or infringes another person's rights;
• Use the Service to promote disordered eating, extreme weight loss, or self-harm.

We may suspend or terminate accounts that violate these rules.

You retain ownership of the workout data, notes, and any other content you submit to MisFIT ("Your Content"). You grant us a limited, worldwide license to host, store, and display Your Content solely as necessary to operate and improve the Service. We do not sell Your Content or use it for third-party advertising.

The Service, including its design, exercise library, brand assets, and underlying software, is owned by MisFIT and protected by intellectual property laws. Nothing in these Terms grants you rights to our trademarks or proprietary content beyond what is necessary to use the Service as intended.

MisFIT relies on third-party infrastructure providers to operate, including Supabase (database and authentication) and Vercel (hosting and analytics), and ZarinPal (payment processing). Your use of the Service is also subject to the applicable terms of these providers where you interact with them directly (for example, during checkout).

You may stop using the Service and delete your account at any time from your profile settings. We may suspend or terminate your access if you violate these Terms, or discontinue the Service in whole or in part with reasonable notice where practicable.

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that logged data will never be lost, though we take reasonable steps to prevent data loss.

To the fullest extent permitted by applicable law, MisFIT and its founders will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold MisFIT harmless from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Service.

These Terms are governed by the laws of Iran, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will first be addressed through good-faith negotiation; if unresolved, it will be submitted to the competent courts of Iran.

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
